Terms & Conditions of Service

1. Preamble & Entity Information

Welcome to the official online and business portal of Culture Haus, a registered brand owned and operated exclusively by A N ENTERTAINMENT PRIVATE LIMITED (hereinafter referred to as "the Company", "Agency", "We", "Us", or "Our").

2. Scope of Engagement & Service Agreements

All production, spatial design, sound engineering, artist programming, stage fabrication, hospitality curation, and event execution undertaken by the Company are governed by a mutually executed Service Level Agreement (SLA) or formal Statement of Work (SOW). The terms present on this website govern website access, communications, and preliminary consultations.

3. Payment Terms, Retainers & Taxes

• Mobilization Advance: A mandatory non-refundable advance fee (as stated in the SOW) is required to secure calendar dates, vendor bookings, and site locks.
• Statutory GST: All commercial quotations and invoices are subject to applicable Goods and Services Tax (GST at 18% or prevailing rate under HSN/SAC codes) under GSTIN: 27ABFCA0598L1Z9.
• Balance Clearance: 100% of the project fee and third-party production expenses must be settled prior to the commencement of the live event.

4. Cancellation, Postponement & Force Majeure

Neither party shall be held liable for failure or delay in performance caused by circumstances beyond reasonable control, including but not limited to acts of God, extreme natural disasters, municipal restrictions, curfews, or sudden government executive orders.

In the event of client-directed cancellation:

• Costs already committed or paid to third-party sub-contractors, venue deposits, flight charters, or non-refundable artist retainers are strictly non-recoverable.
• Postponement of events is subject to date availability within 6 months of the original contracted date.

5. Intellectual Property & Spatial Designs

All custom architectural sketches, CAD diagrams, 3D Unreal Engine renders, set designs, moodboards, and creative treatments generated by Culture Haus / A N ENTERTAINMENT PRIVATE LIMITED remain the sole intellectual property of the Company until full project settlement.

6. Statutory Compliances & Licensing

Unless explicitly specified in the custom SOW, obtaining specific premises licenses, sound permissions, performance royalties (PPL, IPRS, Novex), fire department NOCs, and police permissions will be executed under the statutory guidance of the Company, with government challan fees payable by the client.

7. Limitation of Liability & Dispute Jurisdiction

To the maximum extent permissible by Indian Law, the aggregate liability of A N ENTERTAINMENT PRIVATE LIMITED for any direct claims arising out of any event engagement shall not exceed the management fee actually received by the Company.

Any disputes, controversies, or claims shall be governed by the laws of India and subject to the exclusive jurisdiction of the competent courts in Thane / Mumbai, Maharashtra.
